The Supreme Court, in a wide-ranging judgment, clarifies the meaning of the “knowledge indicators” codified in Article 420-bis, § 2, of the Italian Criminal procedure code. Law no. 134 of 27 September 2021 sets very detailed guidelines aimed at overcoming some critical issues on trial in absentia, which have been creatively solved by the jurisprudence. The Government shall now implement the legislator’s directives in compliance with the supranational guidelines.
